BP arm in court over workplace breaches
A subsidiary of BP Australia will face court in Adelaide this week over claims it
breached workplace laws for hundreds of its staff.
According to a statement from the Fair Work Ombudsman, it has initiated legal action
against No.1 Riverside Quay Pty Ltd, which employs workers at BP service stations
throughout Australia.
Prosecution documents lodged in the Federal Magistrates Court in Adelaide allege the
company failed to follow correct procedures when lodging workplace agreements for
more than 500 staff, the statement says.
Most of the agreements were allegedly non-compliant on matters relating to how they
had to be signed, approved by the employer and employee, dated, witnessed and
lodged.
The employees worked at BP service stations at various locations throughout South
Australia, Queensland, NSW, Victoria and Western Australia.
Fair Work Ombudsman executive director Michael Campbell said in the statement that
it would be claimed there were multiple breaches of both the Workplace Relations Act
and Workplace Relations Regulations.
The maximum penalties are $33,000 per breach of the Act and $5500 per breach of the
Regulations.
The case is listed for a directions hearing on August 4.
