Bikie boss 'beat man with metal bollard'
A witness saw Comancheros bikie leader Mahmoud "Mick" Hawi beat a man with a metal
bollard during a fatal Sydney airport brawl, a court has been told.
Hawi, 28, of Bexley, has been in custody since his arrest on April 6.
He is charged with affray over the March 22 brawl that resulted in the death of
Anthony Zervas, 29, whose brother Peter is a Hells Angel.
During a bail application in Sydney's Central Local Court on Friday, the Office of
the Director of Public Prosecutions (DPP) revealed new evidence against Hawi
contained in one of hundreds of witness statements.
"A person that the crown says is Mr Hawi was seen wielding a bollard and hitting Mr
Anthony Zervas, while Mr Zervas was lying on the ground, three times above Mr
Zervas's waist," the DPP's Marianne Carey read from a witness statement.
Hawi's lawyer John Korn had earlier argued there was no evidence before the court to
link his client to the fatal fight.
But Ms Carey, reading from another witness statement, said a man identified as Hawi
was seen standing near Mr Zervas as he lay on the ground in a pool of blood.
Mr Korn handed two statements to Magistrate David Armati, including one from his
client's pregnant wife and another from her GP, saying Hawi needed "to assist his
wife and be at home when required".
Mr Korn raised the option of house arrest for Hawi if bail was granted.
Hawi's second cousin Hassan Hijazi (Hijazi), 33, presented himself to the court as
an acceptable person to ensure Hawi complied with any bail conditions.
Ms Carey opposed bail, citing the seriousness of the offence, concerns for the
protection and welfare of the community, and allegations Hawi made a threat towards
Peter Zervas at the airport during the incident.
Peter Zervas, 32, was shot in the chest, shoulder, hip and foot as he sat in his car
in the driveway of his southwest Sydney home a week after the brawl. He survived.
"If granted bail, given the level of animosity ... the behaviour of Mr Hawi and his
fellow colleagues on the plane ... the fact Mr Hawi issued a threat to Mr (Peter)
Zervas and the fact he was shot later that week, the crown submits that further
violence would occur in the community," Ms Carey said.
The court adjourned before Mr Korn could complete his submissions.
The magistrate will continue to hear the matter on Tuesday, May 5, when Hawi will
appear by video link.
