Luxury empire Ferragamo keeps trademark right against local shoemaker
SEOUL, Oct. 10 (Yonhap) -- South Korea's top court has ruled in favor of the Italian luxury brand Salvatore Ferragamo, affirming a lower court verdict that a local shoemaker's use of a comparable emblem violates its trademark, documents showed Friday.
The Supreme Court, in a ruling on Thursday, dismissed an appeal by Daeho Corp.,
saying the two emblems are "similar" and therefore, the Korean firm's mark
"belongs to the boundary of the trademark right" of Ferragamo.
The Italian fashion empire filed a complaint with the Seoul-based Intellectual
Property Tribunal in 2005, arguing Daeho's emblem -- two omega (Ω) metal signs
horizontally connected with a small metal rod -- closely resembles that of
Ferragamo.
Daeho had taken the case to the Patent Court, which again ruled in favor of the
luxury brand. The ruling was unanimously affirmed by the top court.
