Sydney man discharged over alleged Ibrahim plot
A Sydney man accused of being part of a murder plot with the Ibrahim brothers has had the case against him thrown out by a magistrate.
Downing Centre Local Court magistrate Michael Brydon on Monday discharged Jim Habkouk, who had been facing a committal hearing charged with conspiring between July 2009 and September 2009 to murder John Macris.
Fadi and Michael Ibrahim, brothers of Sydney nightclub entrepreneur John Ibrahim, and Rodney Atkinson have earlier been ordered to stand trial on the same charge.
The Ibrahims allegedly believed Mr Macris was behind the near-fatal shooting of Fadi Ibrahim almost two years ago.
Fadi Ibrahim was shot fives times as he sat outside his Sydney home in his Lamborghini in June 2009.
Prosecutor Eric Balodis alleged that Mr Habkouk delivered a photograph of Mr Macris to Atkinson, whom the crown says was to be the hitman.
Defence lawyer Andrew Miller said there was no evidence to indicate Mr Habkouk knew what was in the envelope he allegedly delivered.
Mr Miller also said the crown had to prove Mr Habkouk had "knowledge of the plot to kill Mr Macris".
