ARTALYTA SURYANI SENTENCED TO 5 YEARS IN JAIL FOR CORRUPTION

Jakarta, June 29 (ANTARA) - Artalyta Suryani, the defendant in the US$660,000 bribe to public prosecutor Urip Tri Gunawan, was sentenced to five years in jail and fined Rp250 million by the Corruption Court here Tuesday.

"Artalyta Suryani alias Ayin has been found guilty of corruption as defined in Article 5 point 1 b of Law No. 31/1999 which was amended into Law No. 20/2001 on corruption eradication," presiding judge Mansyurdin Chaniago said.

The judge said Artalyta was proven to have asked Urip for information on the process of investigation into the Bank Indonesia Liquidity Assistance (BLBI) case involving obligor Sjamsul Nursalim.

Artalyta had promised to give a certain amount of money to Urip for the information, the judge said, adding that Artalyta also asked for a written summons for Sjamsul Nursalim so that the business tycoon did not need to be questioned at the Attorney General's Office.

On March 2, 2008, Artalyta gave US$660,000 to Urip while the judge rejected the explanations given by Artalyta and Urip that the money was intended to start a business.

"The money was given as a compensation for information on the investigation into the BLBI case," Judge Andi Bachtiar said.

The judge then explained the correlation between the suspension of the BLBI case investigation by the Attorney General's Office and the involvement of Urip and Artalyta in the bribery.

According to the judge, the reason to suspend the BLBI case investigation was the same as the content of the conversation between Urip and Artalyta which was intercepted by Corruption Eradication Commission (KPK) agents.

The Attorney General's Office and Urip said the BLBI case investigation was stopped as the team of investigating prosecutors headed by Urip had not found any unlawful acts amounting to corruption in Nursalim's actions to repay his BLBI debt to the state.

The judge said Artalyta had acted against the Law on Corruption Eradication and Urip had violated Article 12 point 2 of Law No.16/2004 on prosecution obliging any prosecutors to refuse all kinds of gifts related to his or her position.

Urip also violated Article 2 e and Article 3 point 1 of the Government Regulation No.30/1980 on Civil Servants" Discipline.

Meanwhile, Artalyta and her lawyers were considering the verdict. Artalyta remained mum when asked by journalists about the verdict.

The prosecution which had previously demanded a five-year jail sentence for Artalyta accepted the court verdict.
