Thai Administrative Court issues injunction on 3G bidding
BANGKOK, Sept 17 – The planned bidding for Thailand's third generation (3G) wireless service system next Monday came to a halt Thursday as the Administrative Court issued an injunction halting the auction.
The court ruled on Thursday that the National Telecommunications Commission (NTC) had no authority to organise the bidding, saying it had to wait until the National Broadcasting and Telecommunications Commission (NBTC) is established as prescribed under the 2007 Constitution.
The court reasoned the NBTC Bill had already passed readings in both the House of Representatives and the Upper House of Parliament. The bill had also been revised by the Joint Parliamentary Committee and is being brought for consideration by the House again.
The bidding, if allowed to proceed, will cause an obstacle to the performance of NBTC, which is set to be established in the near future.
Consequently, the court decided to issue an injunction to suspend the 3G auction unless there are other rulings.
The ruling puts planned 3G bidding on September 20 to an immediate halt.
However, Col Natee Sakolrat, an NTC member who serves as chairman of the 3G auction committee, said the NTC plans to appeal the decision to the Supreme Administrative Court on Friday.
It would wait for the court’s ruling until September 20 on which the bidding will take place at 9am. Unless there is a ruling on that date, the 3G bidding would be suspended, he said.
Speaking upon the court’s ruling, Information and Communication Technology Minister Chuti Krairiksh said he still believed the 3G bidding would be able to take place within this year.
The government remained committed to its policy to get the 3G wireless system service project off the ground in Thailand, he added.
CAT Telecom had filed a lawsuit against the NTC and seven members of the commission, alleging that they had no authority to organize the 3G auction and had to wait until the NBTC is set up. (MCOT online news)
